On behalf
of the American Bar Endowment, in their dispute with Mutual of Omaha involving
the long term disability plan, Ms. Niehus testified with respect to industry
custom and practice, and calculated the amount of damages. The judge awarded
the Endowment the full amount of damages and commended the excellence
of her testimony in his written opinion (The American Bar Endowment v
Mutual of Omaha Ins. Co., 2002 WL 480960 (N.D. Ill. March 21, 2002)).
